Mandolane Software End User Licence Agreement

1. About this EULA

1.2 Parties
This End User Licence Agreement is between US, Mandolane Software acting on behalf of the software authors, and YOU, the user of the software.

1.2 Applicable Law
The law and legal system of England applies to this licence agreement and all other legal issues arising from the installation and use of this software.

1.3 Acceptance of the EULA
By installing and/or using the software you agree to be bound by the entire terms of this EULA.
If you decide not to accept the terms of this EULA then you must delete the software and all its licence files from all computers on which you have installed it.

1.4 Copyright
Copyright of this software resides with the authors, who have authorised Mandolane to act as their agent for the distribution of software and collection of registration fees. The authors grant to you the right to use the software only within the terms of this EULA.
Paying a registration fee (where applicable) does not confer any rights of ownership of the software.

1.5 Changes to this EULA
From time to time, Mandolane may change the terms of this EULA without notice.

2 Warranty and Liability

2.1 No warranty
Our software is developed on a low budget which limits our ability to exhaustively test the software under all operating conditions and configurations. Your attention is drawn to this limitation and you must take steps to protect and back up your computer and its data before installing and/or using the software.
You use the software entirely at your own risk.
To the maximum extent permitted under applicable law, Mandolane and the authors disclaim any kind of warranty, either express or implied, for the software. Mandolane and the authors make no representation that the software is free from errors. Mandolane and the authors make no representation that it is fit for any particular purpose, application or use. Mandolane and the authors make no representation that the software will execute on any particular computer system, configuration or hardware.

2.1 Malicious Code
The software that we officially release and put on the Mandolane web site does NOT contain any malicious code, spy ware, time bombs, viruses, worms, malware or any other software routines that we have deliberately designed to damage your computer system and/or the data stored on it.
We will take due steps to protect our systems but we cannot guarantee that our servers will not be accidentally, negligently and/or maliciously hacked by an external party. We will not be responsible for any loss and/or damage caused as a result of accidental, malicious and/or other actions by third parties outside our control.

2.2 Liability for Damages
To the maximum extent permitted under applicable law, Mandolane and/or the authors disclaim any liability for any type of damages, whether consequential, incidental, direct or indirect, arising from accident, negligence, malice, installation, removal, use or mis-use of the software or any other cause, even if we have been advised of the possibility of such damages.
Where applicable law states that such liability cannot be disclaimed, then the liability of the author and/or Mandolane is limited to the cost of the registration fee paid by you.

2.3 Liability for Death or Injury
To the maximum extent permitted under applicable law, Mandolane and/or the authors disclaim any liability for death or injury arising from accident, negligence, malice, installation, removal, use or mis-use of the software or any other cause, even if we have been advised of the possibility of such damages
Where applicable law states that such liability cannot be disclaimed, then the liability of Mandolane and/or the author is limited to the cost of the licence fee paid by you.

3 Registration

3.1 Registration Fee
Access to the full capabilities of certain software may only be available once the appropriate registration fee is paid. Until it is registered the software may work in a restricted fashion with fewer capabilities. In all situations and for all software, installation and use of the software is subject to the terms of this EULA.

3.2 Read The EULA
Before you decide to pay a registration fee, you should read the entire EULA and take notice its conditions and limitations.

3.3 Licence File
On payment of the appropriate registration fee to Mandolane , you will receive from us a licence file. This file should be installed on your computer to unlock the full capabilities of the software.

3.4 Single and Multiple Computer Registration Fees
Payment of the single computer registration fee allows you to install the licence file on a single computer. The licence file enables you to unlock the software capabilities for all users or for selected individual users. In every case, all such users will be bound by the entire terms of this EULA.
Payment of the multiple computer registration fee allows you to install the same licence file on multiple computers at a single geographical location and belonging to one household, company, theatre, college or other establishment. In every case, all such users will be bound by the entire terms of this EULA. The licence file is not otherwise transferable and may not be sold, given or otherwise transferred to any other party.

3.5 Termination for Cause
Mandolane and/or the authors may terminate this agreement without notice if you and/or any user for whom you have procured and/or installed a licence file fail to comply with the terms of this EULA. In the event of such termination then the licence file will be invalid for all future updates of the software.

4 Usage Limitations

4.1 Duplication and re-distribution of the software
To ensure that you receive the latest and genuine version of the software, we recommend that you download the software from the Mandolane web site only, and from no other source or mirror.
You may not redistribute or publish the software to third parties without our permission. You may retain one or more copies for the purposes of back up.
Licence files may not be redistributed under any circumstances.

4.2 Forbidden Usage

You are forbidden to use the software in any or all of the following circumstances:

  • In any situation where the use and/or failure of the software may cause death, pain, distress and/or injury to personnel and/or animals

  • In any situation where the use and/or failure of the software may cause damage to the environment

  • In any establishment where the research, development and/or procurement of weapons of any type takes place

  • In any establishment where oppression and/or torture of prisoners takes place.

4.3 Forbidden Activities
You may not cause, attempt, allow or facilitate the following activities in relation to the software:

  • Reverse engineer, decompile and/or disassemble the software

  • Make patches and/or modifications of any sort to the software

  • Generate unauthorised licence files, disable the reminder screens, and/or otherwise defeat the licencing system

  • Distribute licence files to unauthorised third parties

  • Cause or allow the software and/or any licence file to be published on a warez or other site on the internet.
